1. Who we are

In this policy, "858 Sydney", "we", "us" and "our" refer to the business operating the website at 858.sydney and the client platform at app.858.sydney. 858 Sydney is a private, independent buyer's advisory and research practice for buyers of Sydney property. We are not a licensed real estate agency.

We are committed to protecting your privacy and to handling your personal information openly and transparently, consistent with the Australian Privacy Principles. This policy explains what we collect, why, who we share it with, and the choices and rights you have.

2. The kinds of information we collect and hold

We only collect personal information that is reasonably necessary for our functions. Depending on how you interact with us, this may include:

Contact & identity information

Brief & profile information (if you begin a profile or intake)

Communications

Technical information

3. Sensitive information

Some of the information above — such as details of your visa or residency status — may be "sensitive information" under the Privacy Act. We collect sensitive information only where it is reasonably necessary for our service and only with your consent, which you give by choosing to provide it to us for that purpose. We do not use sensitive information for any purpose other than the one for which you provided it, unless you consent or the law permits or requires it.

4. How we collect it

We collect personal information directly from you — when you enquire, message us, begin a profile, or complete an intake on the platform — and, where you ask us to, from advisers or introducers acting on your behalf. Where it is reasonable and practicable, we collect information about you only from you. When we collect your information, we take reasonable steps to make sure you are aware of who we are, why we are collecting it, and how you can contact us.

5. Why we collect, hold, use and disclose it

We use your personal information for the following purposes:

We will not use or disclose your personal information for a purpose other than those above (or a directly related purpose you would reasonably expect) without your consent, unless permitted or required by law.

6. Who we disclose it to

We do not sell your personal information, and we do not disclose it to third parties for their own marketing. We may disclose personal information to:

7. Overseas recipients

Some of our service providers store or process data outside Australia. Based on our current providers, your information may be handled in Singapore and the United States. Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure the recipient handles it consistently with the Australian Privacy Principles, or otherwise rely on a permitted exception. This list may change as our providers change; the current position is available on request.

8. Marketing

We may occasionally send you updates about our service. Every such message will offer a simple way to opt out, and you can also ask us to stop at any time by writing to hello@858.sydney. We do not provide your details to third parties for their marketing.

9. Security & retention

We take reasonable steps to protect your personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure — including access controls, encryption in transit, and limiting who can see your information. No method of transmission or storage is completely secure, but we work to protect your information at all times.

We keep your personal information only for as long as it is needed for the purposes above or to meet our legal obligations, after which we take reasonable steps to de-identify or securely delete it.

10. Data breaches

If we become aware of a data breach that is likely to result in serious harm, we will assess it promptly and, where the Notifiable Data Breaches scheme applies, notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required.

11. Cookies & analytics

Our marketing site uses only the cookies necessary for it to function, and may use privacy-respecting analytics to understand aggregate, non-identifying usage. The platform uses cookies required for secure sign-in. You can control cookies through your browser settings; disabling some cookies may affect how the platform works.

12. Accessing and correcting your information

You may ask us what personal information we hold about you, request a copy of it, and ask us to correct anything that is inaccurate, out of date or incomplete. To make a request, write to hello@858.sydney. We will respond within a reasonable time (ordinarily within 30 days). We may need to verify your identity first, and there is generally no fee to access your information. If we decline a request, we will tell you why and how you can seek a review.

13. Complaints

If you believe we have mishandled your personal information or breached the Australian Privacy Principles, please contact us first at hello@858.sydney. We will acknowledge your complaint, investigate it, and respond — ordinarily within 30 days.

If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC): online at oaic.gov.au, by phone on 1300 363 992, or by writing to GPO Box 5288, Sydney NSW 2001.

14. Children

Our service is intended for adults. We do not knowingly collect personal information from anyone under 18 without the involvement of a parent or guardian. Where a client's brief concerns a child (for example, schooling), we collect only what the parent or guardian chooses to provide.

15. Changes to this policy

We may update this policy from time to time to reflect changes in our practices or the law. The current version is always available here, with the "last updated" date shown above. Material changes will be noted on this page.

16. How to contact us

For any question about this policy, or to make a privacy request or complaint, write to hello@858.sydney. You can also reach us via the details on our contact section.

This policy is provided in good faith and in plain language for transparency. It is not legal advice. It should be reviewed by a qualified Australian privacy lawyer, and updated with the operating entity's registered name and ABN, before being formally relied upon.
